June 13, 2002 Committee of Adjustment M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT MEETING WEST ELGIN COUNCIL CHAMBERS th JUNE 13, 2002 MEMBERS PRESENT: Mayor Duncan McPhail, Deputy Mayor Graham Warwick Councillors: Brad Bandeen, Trudy Balint STAFF PRESENT: Joanne Groch Administrator/Treasurer Linda Cranston Clerk/Deputy-Treasurer ALSO PRESENT: Duncan Morrison Property Owner SUBJECT: MINOR VARIANCE APPLICATION – DUNCAN MORRISON Mayor McPhail called the meeting to order at 9:30 a.m. and welcomed everyone in attendance. The Clerk advised that notice of this meeting had been given under Section 44(5) of the Planning Act by prepaid first class mail to all assessed owners within 60 metres of the subject property as well as provincial agencies and ministries as prescribed by regulation. Correspondence was received from the Lower Thames Valley Conservation Authority, and they have no objections to the minor variance. It was explained that the applicant was in the process of building on an addition to the residence, and in order to accommodate the verandah to be built in front of that, they would require a minor variance, due to the non-compliance with our zoning by-law. The Planner, Ted Halwa had sent his comments, which were circulated to council for review. The dwelling pre-dates the zoning regulations in the former Township of Aldborough and has existed for over 100 years. RES. NO. 1 Moved by Bandeen Seconded by Warwich RESOLVLED that the Municipality of West Elgin grants the minor variance application from Duncan Morrison, Pt. Lot 20, Con. IV Eastern Division to provide relief under the Aldborough Zoning By-Law No. 90-50, specifically Section 5.1.5 for a reduced front yard set-back from 13.7 metres to 11.9 metres (39 ft.) in order to accommodate a verandah in front of their new addition. Reasons: i) The intent of the Township of Aldborough Official Plan is maintained. ii) The intent of the Township of Aldborough Zoning By-Law is maintained. iii) The variance is considered “minor” given the circumstances. iv) The variance is desirable for the appropriate use and development of the lands. 1 2 Committee Members that concur in the decision: Graham Warwick , Trudy Balint. NO. 2 Moved by Balint Seconded by Bandeen RESOLVED that this Committee of Adjustment Meeting held under Section 44(5) of the Planning Act be hereby adjourned.
