SUBJECT: REZONING – PART LOT 7, GORE CONCESSION –
SEBASTIAN AND AGNES PELCZ
Mayor McPhail called the meeting to order at 9:30 a.m. The Clerk informed those
present that notice of this meeting had been given under Section 34(12) of the Planning
Act by prepaid first class mail to all assessed owners within 150 metres of the subject
property as well as provincial agencies and ministries as prescribed by regulation.
Correspondence was received from the Elgin-St. Thomas Health Unit, indicating that
their conditions have been satisfied. Lower Thames Valley Conservation Authority has
no objections.
Ted Halwa, Planning Consultant outlined the request to change the zoning of lands in
part of Lot 7, Gore Concession, from the Agricultural (A1) Zone to the Rural Residential
Three (RR3) Zone and to the “site-specific” Agricultural (A1-38) Zone. The rezoning is a
result of conditions imposed by the County of Elgin Land Division Committee for a
severance application. The lands to be zoned Rural Residential Three (RR3) comprise a
rectangularly-shaped parcel having an area of 3,845 square metres (1.0 acres), a depth
of 60.6 metres (199 feet) and a frontage of 48.8 metres (160 feet) on Downie Line. The
parcel is occupied by a single unit dwelling and a detached shed. The permitted uses of
the RR3 Zone include a single unit dwelling, a home occupation, a bed and breakfast
establishment and an accessory use. The lot would satisfy the minimum lot area,
maximum lot area and minimum lot frontage requirements (1,850 sq. m., 4000 sq. m.
and 30 m. respectively) of the RR3 zone. The lands proposed to be zoned ‘site-specific’
Agricultural (A1-38) comprise the balance of the parcel having an area of 18.4 hectares
(45.3 acres) and a frontage of 297.5 metres (852 feet) on Furnival Road. The ‘site-
specific’ (A1-38) zoning would prohibit a single unit dwelling from being erected on the
lands in accordance with the decision of the Land Division Committee, and would permit
the creation of a lot having less than the minimum lot area requires (19 ha) of the A1
zone. The subject lands are designated Agricultural’ and ‘Restricted Agriculture’ in the
Township of Aldborough Official Plan. The proposed amendment is considered to be in
conformity with the Plan.
