August 28, 2003 Committee of Adjustment M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT WEST ELGIN COUNCIL CHAMBERS AUGUST 28, 2003 MEMBERS PRESENT: Chairman: Duncan McPhail Members: Trudy Balint, Michael Mooser, Graham Warwick, Brad Bandeen STAFF PRESENT: Norma Bryant Secretary –Treasurer Joanne Groch Administrator/Treasurer Chairman Duncan McPhail called the meeting to order at 9:30 a.m. SUBJECT: MINOR VARIANCE APPLICATION A-6/2003 – ALFRED & ESTHER TITUS The Chairman announced a Minor Variance Application of Alfred and Esther Titus, 23750 Pioneer Line, Part of Lot 12, Concession VIII will be considered. Also present: Dean Titus The Secretary/Treasurer advised that proper notice had been given under Section 44(5) of the Planning Act. Comments were received from Lower Thames Valley Conservation Authority, which indicated no objections. Ted Halwa, Planning Consultant was not in attendance. Committee was referred to his th report dated August 28, 2003. The report noted that the lands are zoned Rural Residential Two (RR2) in the Township of Aldborough Zoning By-law 90-50. The applicants are requesting permission to build an addition to their existing garage 3.4 metres (11.0 feet) from the rear property line. The zoning by-law requires a minimum rear yard of 9.0 metres (30 feet). The dwelling on the subject lands, predates the zoning by-law and already encroaches into the required rear yard. If the garage was not attached to the dwelling by the breezeway, it would constitute an accessory building under the zoning by-law for which a rear yard of 1.0 metres would apply. NO. 1 Moved by Bandeen Seconded by Mooser RESOLVED that the Committee of Adjustment grants the minor variance application from Alfred & Esther Titus, Part of Lot 12, Concession VIII, 23750 Pioneer Line, to provide relief under Aldborough Zoning By-law 90- 50, specifically Section 10.1.8, for a reduction in the minimum rear yard depth from 9.0 metres (30 feet) to 3.4 metres (11 feet) to permit an addition to an existing garage. Reasons: i. The intent of the Township of Aldborough Official Plan is maintained. ii. The intent of the Township of Aldborough Zoning By-law is maintained. iii. The variance is considered “minor” given the circumstances. iv. The variance is desirable for the appropriate use and development of the lands.
