Chairman Duncan McPhail called the meeting to order at 10:00 a.m.
SUBJECT: APPOINTMENT OF SECRETARY/TREASURER
RES. NO. 1 Moved by Warwick

RESOLVED that the Committee of Adjustment hereby appoints Norma
Bryant as Secretary-Treasurer.

SUBJECT: MINOR VARIANCE APPLICATION A-1/2003 – BEN ZEGERS
Also in attendance: John Gardiner, Ben Zegers
The Chairman announced that a Minor Variance Application of Ben Zegers, 21799
Johnston Line, Part of Lot 6, Concession III will be considered.
The Secretary/Treasurer advised that proper notice had been given under Section 44(5)
of the Planning Act. No comments have been received.
Ted Halwa, Planning Consultant reported that the applicant wishes to expand his
operation from 1,411 hogs to 2,164 hogs and enlarge the existing livestock building by
604 square metres. The Minimum Distance Separation II (MDS II) provisions of the
zoning by-law require a separation of 540 metres whereas the building is situated 408.4
metres from the nearest single unit dwelling situated on a separate lot to the north. The
relief being sought is 131.4 metres. Mr. Halwa further noted that previous separation
requirements were fixed at 150 metres regardless of type or amount of livestock, the
existing building exceeds this distance. Mr. Halwa recommended that this variance
should be granted.

RESOLVED that the Committee of Adjustment grants the minor variance
application from Ben Zegers, Part of Lot 6, Concession III, Western
Division, to provide relief under Aldborough Zoning By-law 90-50,
specifically Section 5.2.6 and Schedule “H”, for a reduction in the minimum
distance separation from 540 metres (1,771 feet) to 408.4 metres (1,340
feet) to permit an enlarged hog barn.
Reasons: i. The intent of the Township of Aldborough Official Plan
is maintained.
ii. The intent of the Township of Aldborough Zoning
By-law is maintained.
iii. The variance is considered “minor” given the
circumstances
iv. The variance is desirable for the appropriate use and
development of the lands.
