Chairman Duncan McPhail called the meeting to order at 1:30 p.m.
SUBJECT: MINOR VARIANCE APPLICATION A-5/2003 – 1230827 ONTARION INC.
N. & K. BADDER)

The Chairman announced that this is a continuation of hearing for a Minor Variance
Application of 1230827 Ontario Inc. (N. & K. Badder), 288 Graham Road, Part of Lot 7,
R.P. 199 – Village of West Lorne.
Also present: Neil Badder
Ted Halwa, Planning Consultant was not in attendance. Committee was referred to his
th
report dated July 10, 2003. The report noted that discussions had taken place with the
applicant regarding the relocation of the garage and relocation of the proposed lot line
further south. To relocate the southern lot line would require additional surveying and
support/approval from the Land Division Committee, which are considered unnecessary
by Mr. Badder. The report further noted that the new building lot is consistent with the
character of the existing lots situated on the east side on Graham Road which range in
frontage from 20 metres (66 ft.) to 33.5 metres (110 ft.). Realigning its northerly side lot
line would reduce its width to 19.3 metres (63.4 ft.). Given the size and location of the
existing garage and the actual distance it would be from the new property line, it is
unlikely to adversely impact the adjacent building lot or any future dwelling erected on it.

RESOLVED that the Committee of Adjustment grants the minor variance
application from 1230827 Ontario Inc., Part of Lot 7, R.P. 199, 288
Graham Road, to provide relief under Village West Lorne Zoning By-law
89-20, specifically Section 5.1.10 b for a reduction in the minimum side
yard from 1.5 metres (4.9 feet) to 0.7 metres (2.6 feet) from the southerly
lot line for a detached garage.
Reasons: i. The intent of the Village of West Lorne Official Plan is
maintained.
ii. The intent of the Village of West Lorne Zoning By-law is
maintained.
iii. The variance is considered “minor” given the circumstances
iv. The variance is desirable for the appropriate use and
development of the lands.
