July 24, 2003 Rezoning Public Meeting M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN PUBLIC MEETING WEST ELGIN COUNCIL CHAMBERS JULY 24, 2003 MEMBERS PRESENT: Mayor Duncan McPhail, Deputy Mayor Graham Warwick Councillors: Trudy Balint, Brad Bandeen, Mike Mooser STAFF PRESENT: Norma Bryant Clerk ALSO IN ATTENDANCE: Ted Halwa Planning Consultant SUBJECT: REZONING – PART LOT 6, CONC XI – G & M MANNEKE Mayor McPhail called the meeting to order at 9:30 a.m. The Clerk informed those present that notice of this meeting had been given under Section 34(12) of the Planning Act by prepaid first class mail to all assessed owners within 150 metres of the subject property as well as provincial agencies and ministries as prescribed by regulation. Correspondence was received from the Elgin-St. Thomas Health Unit, requiring approval of the sewage disposal system. Lower Thames Valley Conservation Authority has no objections. The Clerk noted the condition of the Health Unit is part of the conditions of severance. The Planner outlined the request to change the zoning of lands in Part Lot 6, Concession XI, from the Agricultural (A1) Zone to the Rural Residential Three (RR3) Zone and to the “site-specific” Agricultural (A1-41) Zone. The rezoning is a result of conditions imposed by the County of Elgin Land Division Committee for a severance application. The lands to be zoned Rural Residential Three (RR3) comprise a rectangularly-shaped parcel having an area of 3,999 square metres (1.0 acres), a depth of 60.5 metres (198.5 feet) and a frontage of 66.1 metres (216.9 feet) on Furnival Road (County Road No. 103). The existing single unit dwelling (10375 Furnival Road) was erected in 1989. The permitted uses of the RR3 Zone include a single unit dwelling, a home occupation and an accessory use. The lot would satisfy the minimum lot area, maximum lot area and minimum lot frontage requirements (1,850 sq. m., 4000 sq. m. and 30 m. respectively) of the RR3 zone. The lands proposed to be zoned ‘site-specific’ Agricultural (A1-41) comprise the remainder of the farm having a frontage of approximately 539 metres (1,768 feet) on Furnival Road and an area of 39.7 hectares (98 acres). Buildings and structures include a single unit dwelling (22239 Thomson Line) and three barns. The proposed ‘site-specific’ (A1-41) zoning would prohibit the erection of a dwelling on this parcel in accordance with a condition imposed by the Land Division Committee in granting Application for Consent E52/02. The subject lands are designated Agricultural’ in the Township of Aldborough Official Plan. The proposed amendment is considered to be in conformity with the Plan.
