March 27, 2003 Committee of Adjustment McFadden M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT WEST ELGIN COUNCIL CHAMBERS th March 27, 2003 MEMBERS PRESENT: Chairman: Duncan McPhail Members: Graham Warwick Trudy Balint, Brad Bandeen STAFF PRESENT: Norma Bryant Secretary -Treasurer ALSO IN ATTENDANCE: Ted Halwa Planning Consultant Chairman Duncan McPhail called the meeting to order at 2:00 p.m. SUBJECT: MINOR VARIANCE APPLICATION A-3/2003 – ERNEST MCFADDEN The Chairman announced that a Minor Variance Application of Ernest McFadden, represented by Richard McFadden (agent) 12570 Furnival Road, Part of Lot 7, Concession 8 will be considered. The Secretary/Treasurer advised that proper notice had been given under Section 44(5) of the Planning Act. Comments were received from Lower Thames Valley Conservation Authority, which indicated no objections. Ted Halwa, Planning Consultant reported that the lands are zoned Rural Residential Two (RR2) in the Township of Aldborough Zoning By-law 90-50. The applicant is requesting permission for an auto repair business to be housed in an existing building (barn), which has been used for the purposes of a trucking business. The committee has broad powers and if non-conforming use is in existence and continues the committee can give permission to extend to another compatible use. The committee also has the powers to impose conditions. Discussion arose whether this use is compatible to the existing residential uses. Mr. Rick McFadden reported he has met with the neighbours and they were in support of the application. No one has attended this meeting to object. Mr. McFadden reviewed the proposed conditions and agreement was sought regarding outside storage and planting. March 27, 2003…Pg 2 of 2 RES. NO. 1 Moved by Warwick Seconded by Bandeen RESOLVED that the Committee of Adjustment grants permission for Ernest McFadden, located on Part of Lot 7, Concession 8, 12570 Furnival Road, to use the lands and buildings for an auto-repair business subject to the following conditions. 1. that permission shall only remain in effect as long as the auto repair business is operated solely by Mr. Rick McFadden ii. that outside storage be restricted to the lands lying between the building and the rear lot line iii. that a site plan, accurate and drawn to scale, be submitted showing the location of the subject buildings and measures to be undertaken to provide screening in front of the building and along the southerly lot line to the satisfaction of the Municipality. Reasons: i. The proposed auto repair business is similar to an existing trucking business which has been conducted from the subject lands long before regulation regarding the use of land were in effect in the former Township of Aldborough. ii. The conditions applied will minimize any adverse impacts on neighbouring uses.
