March 27, 2003 Committee of Adjustment McQuade & Ryerse M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT WEST ELGIN COUNCIL CHAMBERS th March 27, 2003 MEMBERS PRESENT: Chairman: Duncan McPhail Members: Graham Warwick Trudy Balint, Brad Bandeen STAFF PRESENT: Norma Bryant Secretary -Treasurer ALSO IN ATTENDANCE: Ted Halwa Planning Consultant Chairman Duncan McPhail called the meeting to order at 1:30 p.m. SUBJECT: MINOR VARIANCE APPLICATION A-2/2003 – DENNIS MCQUADE & LINDA RYERSE The Chairman announced that a Minor Variance Application of Dennis McQuade and Linda Ryerse, 171 Chestnut Street, Part of Lot 61, Registered Plan 299 will be considered. The Secretary/Treasurer advised that proper notice had been given under Section 44(5) of the Planning Act. Comments were received from Lower Thames Valley Conservation Authority, which indicated no objections. The Planner reported that the lands are zoned Residential First Density (R1) in the Village of West Lorne Zoning By-law 89-20. The applicants are requesting permission to build an addition to their residential dwelling 0.3 metres (1.0 feet) from the side property line. The zoning by-law requires a minimum side yard of 1.5 metres (4.9 feet). The proposed addition would be situated the same distance from the side property line as the existing dwelling. The Planner suggested that the addition be redesigned or land be acquired from the neighbour as trespassing will occur on neighbouring property when maintenance, grass cutting is required. Mr. McQuade reported that the variance is required to complement the architectural design of the existing dwelling. Further, it would be too cost prohibitive to acquire lands. The slope of the roof faces backyard and front yard, so overhang does not occur in the side yard. If there is a concern regarding windows facing onto the side yard, skylights could be substituted. No one was in attendance to object to this proposal. March 27, 2003…Pg 2 of 2 RES. NO. 1 Moved by Warwick Seconded by Bandeen RESOLVED that the Committee of Adjustment grants the minor variance application from Desmond McQuade and Linda Ryerse, Part of Lot 61, Registered Plan 199, 171 Chestnut Street, to provide relief under West Lorne Zoning By-law 89-20, specifically Section 5.1.10, for a reduction in the minimum side yard from 1.5 metres to 0.3 metres to permit an addition to the rear of the existing dwelling including an attached garage. Reasons: i. The intent of the Village of West Lorne Official Plan is maintained. ii. The intent of the Village of West Lorne Zoning By-law is maintained. iii. The variance is considered “minor” given the circumstances iv. The variance is not desirable for the appropriate use and development of the lands.
