SUBJECT: REZONING –11943 GRAHAM RD - PT LOT 18, CONC 8 - HAWKEN

Mayor McPhail called the meeting to order at 9:30 a.m. The Administrator/Treasurer
informed those present that notice of this meeting had been given under Section 34(12)
of the Planning Act by prepaid first class mail to all assessed owners within 150 metres
of the subject property as well as provincial agencies and ministries as prescribed by
regulation.
Correspondence was received from Lower Thames Valley Conservation Authority
indicating they have no objections.
Ted Halwa, Planning Consultant outlined the request to permit establishment of an
outdoor recreational use being a ‘paintball park’ on a portion of the parcel. The proposed
zoning is from the Agricultural (A1) Zone to the ‘site-specific’ Open Space (OS-#) Zone.
The ‘site-specific’ zoning would restrict the uses on the parcel to a paintball park,
conservation area, forestry use, a single unit dwelling as well as other uses of the A1
Zone. The subject lands are in conformity with the Township of Aldborough Official Plan
designation of ‘Restricted Agricultural’ and ‘Wetland’, which allows recreational uses in
the rural area. No new buildings or structures are proposed.
The owners have requested a permanent zoning. Ted advised that a temporary use by-
law could be passed to permit the proposed paintball park for a period of up to three
years. At the end of three years application could be made to further extend the
temporary use or bring a permanent zoning into effect. There is a provincially-significant
wetland on the property but it is far enough away that there will be no encroachment.
There are a number of ways the by-law can be structured. The use could be added as a
permitted use under the A1 zoning. The property could be zoned OS with a range of
restricted uses as indicated. A wide open OS zoning would be premature.
Don Hawken indicated that he had positive feed back from the community. It may
develop into a spectator sport with parents watching rather than just a participant sport.
Any capital expenditures would be a long-term project. Mrs. Hawken advised that the
camping would be at the back of the property close to the trees.

There was discussion on the accessory uses permitted. Camping would only be
permitted for users of the facility – a commercial/independent campground is not
permitted. A concession stand is a permitted accessory use.
It was agreed to change to an OS–site specific zoning and the Clerk was directed to
prepare a by-law for the next Council meeting.
Mr. & Mrs. Hawken were advised that the by-law would be passed at the next meeting

on June 12 and there would be a twenty day appeal period from the date of mailing.
