Chairman Graham Warwick called the meeting to order at 1:30 p.m.
SUBJECT: MINOR VARIANCE APPLICATION A1/2004 – TEX & DEB TOBIAS

The Chairman announced a Minor Variance Application of Tex and Deb Tobias, 93
William Street, Part of Lot 20, Concession IX will be considered.
The Secretary/Treasurer advised that proper notice had been given under Section 44(5)
of the Planning Act. Comments were received from Lower Thames Valley Conservation
Authority, which indicated no objections.
Ted Halwa, Planning Consultant was not in attendance. It is noted that the lands are
zoned Rural Residential Two (RR2) in the Township of Aldborough Zoning By-law 90-
50. The applicants are requesting permission to erect an addition (being an attached
garage) on the east side of the dwelling. This would result in an easterly side yard of 0.9
metres (3.0 feet) and a front yard of 5.2 metres (17 feet). The zoning by-law requires a
minimum side yard of 1.5 metres (4.9 feet) and a minimum front yard depth of 7.5
meters (24.6 feet). The dwelling on the subject lands, predates the zoning by-law and
already encroaches into the required front yard.

RESOLVED that the Committee of Adjustment grants the minor variance
application from Tex & Deb Tobias, Part of Lot 20, Concession IX, 93
William Street, to provide relief under Aldborough Zoning By-law 90-50,
specifically Sections 9.1.5 and 9.1.6, for a reduction in the front yard depth
from 7.5 metres to 5.2 metres and side yard width from 1.5 metres to 0.9
metres to permit an attached garage.
Reasons: i. The intent of the Township of Aldborough Official
Plan is maintained.
ii. The intent of the Township of Aldborough Zoning
By-law is maintained.
iii. The variance is considered “minor” given the
circumstances.
iv. The variance is desirable for the appropriate use
and development of the lands.
