SUBJECT: REZONING – PART LOT D, CONC VIII WD – A & L KIERASZEWICZ
The Mayor called the meeting to order at 9:30 a.m. The Clerk informed those present
that notice of this meeting had been given under Section 34(12) of the Planning Act by
prepaid first class mail to all assessed owners within 150 metres of the subject property
as well as provincial agencies and ministries as prescribed by regulation.
Correspondence was received from the Lower Thames Valley Conservation Authority,
which indicated no objections.
The Planner outlined the request to change the zoning of lands situated on the south
side of McMillan Line (County Road No. 104) west of Blacks Road, being part of Lot D,
Concession VIII (Western Division), from the Agricultural (A1) Zone to the 'site-specific'
Special Agricultural (A2-17) Zone and to the ‘site-specific’ Agricultural (A1-46) Zone.
The re-zoning is necessary to maintain compliance with the Zoning By-law and fulfill a
condition imposed by the County of Elgin Land Division Committee in granting
permission to sever a parcel occupied by a single unit dwelling and various accessory
buildings out of a larger 60.3 hectare (149 acre) parcel for the purpose of disposing a
surplus farm dwelling (Application for Consent E59/03). The conditions for the creation
of a lot to dispose a surplus farm dwelling under the Township of Aldborough Official
Plan and the Provincial Policy Statement appear to be satisfied.
The lands proposed to be zoned 'site-specific' Special Agricultural (A2-17) have an area
of 7,600 square metres (1.9 acres), an irregular depth and a frontage of 76 metres (249
feet) on McMillan Line (County Road No. 104). The existing dwelling (20721 McMillan)
was erected in 1902. The permitted uses of the A2 zone include a single unit dwelling, a
home occupation, agricultural use as an accessory use and an accessory use. The lot
would satisfy the minimum lot area, maximum lot area and minimum lot frontage
requirements (4,000 sq. m., 1.0 ha and 50 m respectively) of the A2 zone. A 'site-
specific' (A2-17) zoning is being considered to recognize the existing accessory
buildings which, in total, slightly exceed the maximum 10% lot coverage standard in the
A2 zone. The Planner further noted that as a result of the Nutrient Management Act the
number of livestock cannot be limited under the zoning by-law.

The lands proposed to be zoned ‘site-specific’ Agricultural (A1-46) comprise the
remainder of the farm having a frontage of 566 metres (1,857 feet) on McMillan Line and
an area of 59.5 hectares (147 acres). The proposed ‘site-specific’ (A1-46) zoning would
prohibit the erection of a dwelling on this parcel in accordance with the Official Plan and
a corresponding condition imposed by the Land Division Committee in granting the
Application for Consent.
The subject lands are designated 'Agricultural' in the Township of Aldborough Official
Plan. The proposed Amendment is considered to be in conformity with the Plan.
