July 08, 2004 Committee of Adjustment M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT WEST ELGIN COUNCIL CHAMBERS JULY 8, 2004 MEMBERS PRESENT: Chairman: Graham Warwick Members: Trudy Balint, Mary Bodnar, Michael Mooser, Bernie Wiehle STAFF PRESENT: Norma Bryant Secretary –Treasurer Joanne Groch Administrator/Treasurer Chairman Graham Warwick called the meeting to order at 1:30 p.m. SUBJECT: MINOR VARIANCE APPLICATION A2/2004 – 1331124 ONTARIO INC. (WEST ELGIN VARIETY) Also in attendance: Martin Joldersma, Ahmad Rachide The Chairman announced a Minor Variance Application of West Elgin Variety, 263 Graham Road, will be considered. The Secretary/Treasurer advised that proper notice had been given under Section 44(5) of the Planning Act. Comments were received from Lower Thames Valley Conservation Authority, which indicated no objections. Council reviewed a report from the Planning Consultant. It is noted that the lands are zoned ‘site specific’ Residential First Density (R1-2) in the Village of West Lorne Zoning By-law 89-20. The owner proposes to remove the existing gas bar and replace it with a new gas and a canopy in closer proximity to the variety store. The canopy would be 3.0 metres (10 feet) from the property line along John Street and 11.0 metres (36 feet) from the property line along Graham Road. The zoning by-law requires a minimum front yard of 6.0 metres (19.7 feet). The owner has indicated that the new gas bar will result in improved customer service and site aesthetics, and facilitate future development of the site. The report recommends that any fuel pump be located no closer than 6.0 metres from the property line. Mr. Joldersma indicated that the proposed location of the pumps is closer than 6.0 metres. The posts that hold the canopy will be 4.0 metres and the pumps will be in the same location as the posts. The applicant had requested the variance of 3.0 metres for gas pumps, canopy and supporting posts. July 8, 2004…..Page 2 of 2 RES. NO. 1 Moved by Mooser Seconded by Balint RESOLVED that the Committee of Adjustment grants the minor variance application from 1331125 Ontario Inc. (West Elgin Variety), Lots 3 & 4, Block ‘O’, Plan 68, 263 Graham Road to provide relief under West Lorne Zoning By-law 89-20, specifically Section 5.3.2 c) for a decrease in the front yard depth from 6 metres (19.7 feet) to 3.0 metres (10 feet) for a gas bar including overhead canopy. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That any fuel pump is located no closer than 3.0 metres from the property line. 2. That the existing northernmost entrance on Graham Road is physically removed and closed and the lands restored at no cost and to the satisfaction of the County of Elgin and the Municipality. 3. That all matters pertaining to lot grading and drainage are addressed to the satisfaction of the Municipality, prior to the issuance of a building permit for the gas bar. Reasons: i. The intent of the West Lorne Official Plan is maintained. ii. The intent of the West Lorne Zoning By-law is maintained. iii. The variance is considered “minor” given the circumstances iv. The variance is desirable for the appropriate use and development of the lands.
