October 28, 2004 Public Rezoning Meeting Bodnar M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN PUBLIC MEETING WEST ELGIN COUNCIL CHAMBERS OCTOBER 28, 2004 MEMBERS PRESENT: Deputy Mayor Bernie Wiehle Councillors Trudy Balint, Michael Mooser STAFF PRESENT: Joanne Groch Administrator/Treasurer Norma Bryant Clerk ALSO IN ATTENDANCE: Ted Halwa Planning Consultant SUBJECT: REZONING – PART LOT 2, CONC X – S BODNAR No one in attendance The Deputy Mayor called the meeting to order at 9:30 a.m. The Clerk informed those present that notice of this meeting had been given under Section 34(12) of the Planning Act by prepaid first class mail to all assessed owners within 150 metres of the subject property as well as provincial agencies and ministries as prescribed by regulation. Correspondence was received from the Lower Thames Valley Conservation Authority, which indicated no objections and the Elgin St. Thomas Health Unit which indicated their conditions regarding the severance application have been met. The Planner outlined the request to change the zoning of lands situated on the south side of Marsh Line east of the Blacks Lane, being part of Lot 2, Concession I0, from the Agricultural (A1) Zone to the Special Agricultural (A2) Zone and to the ‘site-specific’ Agricultural (A1-52) Zone. The re-zoning is necessary to maintain compliance with the Zoning By-law and fulfill a condition imposed by the County of Elgin Land Division Committee in granting permission to create a lot (Application for Consent E69/04) for retirement purposes. The lands proposed to be zoned Special Agricultural (A2) comprise a rectangular- shaped parcel having an area of 4,070 square metres (1.0 acres), a depth of74 metres (243 feet) and a frontage of 55 meters (180 feet). The parcel is devoid of buildings and structures and a single unit dwelling is proposed to be erected. The permitted uses of the A2 zone include a single unit dwelling, a home occupation, a bed and breakfast establishment, an agricultural use as an accessory use and an accessory use. The lot would satisfy the minimum area, maximum lot area and minimum lot frontage requirements (4,000 sq. m., 1.0 ha. and 50 m, respectively) of an A2 zone. The lands proposed to be zoned “site-specific” Agricultural (A1-52) comprise the remainder of the farm, having a frontage of approximately 246 metres (807 feet) on Marsh Line and an area of 19.8 hectares (49 acres). The proposed “site-specific” (A1- 52) zoning would prohibit the erection of a dwelling in accordance with the Official Plan, thereby satisfying a condition imposed by the Land Division Committee in granting permission to create the lot out of the farm for retirement purposes. The subject lands are designated 'Agricultural' in the Township of Aldborough Official Plan. The By-law is considered to be in conformity with the Plan. SUBJECT: ADJOURNMENT RES.
