June 30, 2005 Special Session M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN SPECIAL SESSION JUNE 30, 2005 MEMBERS PRESENT: Mayor Graham Warwick, Deputy Mayor Wiehle Councillors: Trudy Balint, Mary Bodnar, Michael Mooser STAFF PRESENT: Joanne Groch Administrator/Treasurer Norma Bryant Clerk ALSO PRESENT: Ted Halwa Planning Consultant SUBJECT: COURT OF REVISION – LETTNER DRAIN RES. NO. 1 Moved by Mooser Seconded by Balint RESOLVED that the members of the Court of Revision on the Lettner Drain be as follows: Chairman: Mary Bodnar Members: Graham Warwick, Mike Mooser, Bernie Wiehle, Trudy Balint DISPOSITION: Carried Council adjourned to hold a Court of Revision on the Lettner Drain and resumed their meeting thereafter. SUBJECT: DRAFT OFFICIAL PLAN The Planner presented a map of the “shoreline” area showing existing and proposed land uses. The following comments were made: ? Agriculture predominant in most westerly and most easterly areas ? Provincially significant known as the Elgin Kent Shoreline ANSI is indicated, this was not part of our previous Official Plan. Why is this designated now? ? Existing long narrow lots in Lot C should be shown and indicated as “shoreline residential” ? Map should indicate which part of Grey Line is not maintained at all ? Proposed development area for Port Glasgow shown in white, area at end of Graham Road should also be shown in white. ? Should encourage multi-unit / retirement communities ? Condominium legislation allows the corporation to take responsibility in the long term for communal septic systems ? Need to address seasonality of trailer parks, hard to regulate through zoning ? Should lot 19 should be residential or agricultural as road is not to municipal standards. May need to scale back to satisfy province ? Should area west of Port Glasgow be specified for recreational (i.e. trailer parks) only or specify residential/recreational. Flexibility better – allow either. June 30, 2005…Pg 2 of 3 ? Should any lands on north side of Grey Line be designated as residential? Suggestion one lot depth. ? Reference in plan to have buildings erected in such a way that they can be removed due to erosion problem? ? No reference to development charges in plan The Planner left the meeting. DELEGATION: JAYSON CHABOT, IRON RAIL SECURITY Mr. Chabot appeared before Council to provide a proposal for by-law enforcement services. His company does parking enforcement, property standards, picks up dogs at large, dog tag sales for various municipalities. He outlined the procedure they use for property standards infractions. They work on a complaint basis, referred to him by the municipality. They hand deliver letters to properties and find this is an effective approach for gaining compliance. If absentee landowner, will send by registered mail. If they are visiting a property and see other problems such as a fence lacking around a pool, they will address that issue with the property owners and advise the municipality. Standardized letters are used. There are 6 trained by-law enforcement officers on staff. Jayson will attend council meetings every 3 months to report. After Council discussion with Jayson, the Mayor thanked him for his presentation. SUBJECT: BY-LAW ENFORCEMENT OFFICER RES. NO. 2 Moved by Mooser Seconded by Balint RESOLVED that Council accepts the resignation of William Douglas, effective June 30, 2005. DISPOSITION: Carried Council directed staff to bring forward an agreement to contract Iron Rail Security to provide by-law enforcement services. This would apply to the enforcement of the same by-laws as present. A 12 month probation period is requested. SUBJECT: RENEWAL OF OCWA SERVICES AGREEMENT The Clerk reported that under the agreement with OCWA the municipality must give six months notice of renewal or termination. RES. NO. 3 Moved by Mooser Seconded by Balint RESOLVED that Council of the Corporation of the Municipality of West Elgin agrees to the renewal with OCWA for the operation of the Water Treatment Plant for the year 2006. DISPOSITION: Carried SUBJECT: HOUSEHOLD HAZARDUOUS WASTE COLLECTION The Clerk reported that Dutton-Dunwich has approached the municipality to share in the costs of hosting a household hazardous waste day in the fall. A cost estimate of $3500 to $4000 has been provided by Clean Harbor for our share. The actual amount will be determined based on use by West Elgin residents. There may be a requirement to have West Elgin staff assist on site on the day. June 30, 2005…Pg 3 of 3 RES. NO. 4 Moved by Wiehle Seconded by Mooser RESOLVED that Council agrees to participate in a household hazardous waste day with Dutton-Dunwich. DISPOSITION: Carried SUBJECT: CONFIRMATION BY-LAW RES. NO. 5 Moved by Bodnar Seconded by Balint RESOLVED that the mover be granted leave to introduce a by-Law to confirm the proceedings of the special meeting of Council held on June 30, 2005 and this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried RES. NO. 6 Moved by Balint Seconded by Bodnar RESOLVED that a By-law to confirm the proceedings of the special meeting of Council held on June 30, 2005 be now read a third time and finally passed, signed, sealed and numbered By-law Number 2005-45 – Confirming By-law June 30 2005 DISPOSITION: Carried SUBJECT: ADJOURNMENT RES.
