May 05, 2005 Special Session M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN SPECIAL SESSION MAY 5, 2005 MEMBERS PRESENT: Mayor Graham Warwick, Deputy Mayor Wiehle Councillors: Trudy Balint, Mary Bodnar, Michael Mooser STAFF PRESENT: Joanne Groch Administrator/Treasurer Norma Bryant Clerk ALSO PRESENT: Ted Halwa Planning Consultant DELEGATION: KEN ROODZANT RE: PART OF LOT 6, CONCESSION IX Also present: Brett Lee, David Cornwall, Leonie Cornwall, Ken Roodzant, Cynthia Roodzant, Jane Garrett The Mayor welcomed those in attendance. He noted that the motocross racetrack has recently come to Council’s attention. The purpose of the meeting was to receive information from Mr. Roodzant regarding the motocross facility operating on his property. Mr. Roodzant and the others in attendance provided the following information: ? Use has evolved to having formal racing that are sanctioned by Canadian Motorsport Racing Club (CMRC) ? Non-profit organization set up to operate facility, began in March ? Goal is to provide safe, family oriented motocross ? Track must be CMRC safety and quality of track guidelines. Races have certified official, insurance stipulates medics must be on site. Quality of track has improved under new Board ? Goal is see community prosper, donate to service clubs ? Dust is now being kept under control ? Noise – berms will be erected and starting point of races may be changed to alleviate ? Need events to support track, considering membership ? Camping is not permitted ? Have Directors insurance, race day insurance through CMRC. ? Pond has been dug to provide water for dust control ? Would like to hold 4 events per year ? Parking is provided on-site, controlled entry ? If it is too dusty, race is stopped as unsafe The Planner reported that this use is not in compliance with zoning by-law. Fines for non-compliance are substantial. Need to go through public process to be sanctioned under zoning by-law. Part of that process is a justification of the use, impact on loss of agriculture, noise and dust will be considered. Options are temporary or permanent rezoning. Based on previous experience with motocross tracks, temporary zoning has May 5, 2005…Pg 2 of 3 been used. Activity is similar to others, start out innocently but now that it is open to public and have scheduled events no longer a permitted use. Should shut down races. The members of the public left the meeting. SUBJECT: CLOSED SESSION RES. NO. 1 Moved by Wiehle Seconded by Mooser RESOLVED that the Council of the Municipality of West Elgin adjourn to a closed session to discuss litigation or potential litigation. DISPOSITION: Carried RES. NO. 2 Moved by Mooser Seconded by Wiehle RESOLVED that the Council of the Municipality of West Elgin do now rise and report. DISPOSITION: Carried Councillor Mooser left the meeting. SUBJECT: PART OF LOT 6, CONCESSION IX RES. NO. 3 Moved by Bodnar Seconded by Wiehle RESOLVED that the owner(s) of Part of Lot 6, Concession 9 are hereby notified that the use of the lands as a moto-cross facility is in contravention of the Zoning By-law and that such use immediately cease. DISPOSITION: Carried SUBJECT: CONFIRMATION BY-LAW RES. NO. 4 Moved by Balint Seconded by Bodnar RESOLVED that the mover be granted leave to introduce a by-Law to confirm the proceedings of the special meeting of Council held on May 5, 2005 and this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried RES.
