October 13, 2005 Public Rezoning Meeting M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN PUBLIC MEETING WEST ELGIN COUNCIL CHAMBERS OCTOBER 13, 2005 MEMBERS PRESENT: Mayor Graham Warwick, Deputy Mayor Bernie Wiehle Councillors: Trudy Balint, Mary Bodnar, Mike Mooser STAFF PRESENT: Joanne Groch Administrator/Clerk Norma Bryant Clerk SUBJECT: REZONING – MINIMUM DISTANCE SEPARATION II Also present: Hank Dieker The Mayor called the meeting to order at 1:30 p.m.. The Clerk informed those present that notice of this meeting had been given under Section 34(12) of the Planning Act by th advertisement in the Chronicle on September 15, 2005. The proposed amendment would change the provisions of the Zoning By-law that apply to situations where new or expanding livestock operations are locating or expanding in proximity to lands zoned General Industrial (M2). Under the Zoning By-law, Schedule “H” constitutes Minimum Distance Separation II. MDS II is a formulae used for the purposes of determining the minimum distance to be maintained between new or expanding livestock buildings, structures and manure storage facilities and non- agricultural uses located on a separate lot. It applies to all lands zoned Agricultural (A1). In determining the actual separation distance in a particular situation, the base separation distance between a new or expanding livestock building, structure or manure storage facility on lands zoned Agricultural (A1) and lands zoned General Industrial (M2) is doubled. The proposed amendment would eliminate the doubling of the distance, consistent with MDS II as developed and applied by the Ministry of Agriculture and Food. Under the Township of Aldborough Official Plan (Section 2.1.4), all new or expanding livestock operations are required to meet the requirements of the Agricultural Code of Practice now the Guide To Agricultural Land Use. The Guide contains the formulae for calculating minimum separation distances between livestock buildings, structures and manure storage facilities and non-agricultural uses. It becomes a regulation (as opposed to a guideline) upon incorporation into a municipality’s zoning by-law. The proposed amendment is considered to be in conformity with the Plan .
