October 27, 2005 Regular Meeting M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN WEST ELGIN COUNCIL CHAMBERS OCTOBER 27, 2005 MEMBERS PRESENT: Mayor Graham Warwick, Deputy Mayor Bernie Wiehle Councillors Trudy Balint, Mary Bodnar STAFF PRESENT: Joanne Groch Administrator/Treasurer/Deputy- Clerk ALSO PRESENT: Ted Halwa Planning Consultant DECLARATION OF PECUNIARY INTEREST: None. SUBJECT: PRELIMINARY SEVERANCE – PART LOT 9, CONCESSION 8 (1079245 ONTARIO LIMITED – OSSEL) Mr. Ossel was in attendance. Council reviewed a preliminary severance application to sever a .6-acre parcel with a surplus dwelling on it from a 45-acre parcel on Queens Line. The property is designated Agricultural in the Official Plan and zoned A1. Mr. Ossel advised that his son lives in the corner house and he wishes to sever the rental house. The Planner reported that the application conforms to the Official Plan and the Provincial Policy Statement. Council supported the proposed severance subject to the usual conditions. SUBJECT: DRAFT OFFICIAL PLAN The Planner presented a list of outstanding matters for discussion: Home Occupations and businesses ? Section 5.2.7 agricultural areas – farm related – not necessarily related to farming, more permissive ? Section 4.22 – villages – most restrictive – within a dwelling/garage ? Section 7.22 – rural residential - within dwelling/accessory building ? Should more businesses be allowed ? Barns used for storage of antique cars, boats – inside versus outside storage ? No outside storage ? Lakeshore Residential zone – Lakeview Estates - request has been made for Home Occupation for home day care for children – residential area - not the type of development for a business Outdoor Recreational uses ? Section 5.2.10 – in rural areas – specific use specified in zoning by-law October 27/05…Pg 2 of 6 Rail line abandonment ? Awaiting status report from CN ? Don’t want to discourage use as a railway Bicycle route ? Show route on the Official Plan Specific requests ? Approval was given to requests from Almeida (Lot 18 C 8), Bet-Har Farms Ltd (Lot 6, C 7), Kocsis (Lot 4, C 14) and Mosher (Lot 7, C 12) ? Council denied requests from Doherty (Lot 18, C 9), Kalita Farms (Lot 19, C 13) and DeWit (Lot 7, C 2) All recommendations from this meeting and previous discussions will be complied for th the November 17 meeting. SUBJECT: UPDATE ON MELODY CHURCH OMB APPEAL The Planner has had discussion with the lawyer – John Judson – does Council want to proceed to mediation. Council agreed that mediation is not an option. SUBJECT: PORT GLASGOW YACHT CLUB - IMPROVEMENTS Mayor Warwick advised that the Yacht Club is planning to upgrade the marina basin to allow for a boat dock and a deck. The work is to be done on the peninsula’s south side where currently there is only rock rubble. They are making application for Trillium Funding and are requesting a letter of endorsement. Council authorized a letter be prepared for the Yacht Club. SUBJECT: SOUTHWESTERN ORTHOPHOTOGRAPHY PROJECT – SWOOP The Administrator reported that West Elgin is one of three municipalities in Southwestern Ontario that have chosen not to participate in SWOOP. The estimated cost is $950.00. Joanne advised that originally she didn’t feel that we needed another aerial photograph since we had the one from the Lower Thames Valley Conservation Authority project that is only a few years old. However, this mapping will use digital technology and is more advanced than the one we currently have. RES. NO. 1 Moved by Wiehle Seconded by Balint THAT the Council of the Municipality of West Elgin participate in SWOOP – Southwestern Orthophotography Project at an estimated cost of $950.00. Disposition: Carried DELEGATION: NORMA SCHNEKENBURGER, ED KEBBEL RE: WEST ELGIN CITIZENS’ GROUP FOR RURAL EDUCATION Norma Schnekenburger and Ed Kebbel outlined the activities for 2004-2005 updating Council on their progress. A Financial Statement was also presented. Mayor Warwick thanked them for their hard work. NO. 2 Moved by Bodnar Seconded by Balint RESOLVED that Council of the Municipality of West Elgin is in support of a resolution put forth by the City of Peterborough and hereby petitions the Ministry of Community Safety and Correctional Services to re-affirm their support of the Community Emergency Response Volunteers (CERV) Funding; AND FURTHER that the Ministry of Community Safety and Correctional Services re-instate envelope funding to provide municipalities throughout Ontario the opportunity to train and certify their residents to ensure that they continue to make communities stronger and safety resilient; AND FURTHER that the Ministry of Community Safety and Correctional Service expand the parameters of this funding to be available to municipalities to retain the services of any organizations that will assist municipalities in a similar way as CERV to meet the volunteer needs of the community in an emergency situation. NO. 3 Moved by: Balint Seconded by: Wiehle RESOLVED that Council of the Municipality of West Elgin has no objections to the Children’s Health Foundation sale of lottery tickets within the municipality. DISPOSITION: Carried 4. Tiny Tots Co-Operative Nursery School – Fundraiser – use of meeting room at Rodney Recreation Centre Instruction: File RES. NO. 4 Moved by Balint Seconded by Bodnar RESOLVED that Council of the Municipality of West Elgin waives the user fee for the use of the Rodney Recreation Centre for the Tiny Tots to host a “Scrap-A-Thon” fundraiser on November 26, 2005. DISPOSITION: Carried 5.* Rodney Aldborough Agriculture Society – permanent sign at entrances to Rodney Instruction: RES. NO. 5 Moved by Balint Seconded by Bodnar RESOLVED that Council of the Municipality of West Elgin approves the request of the Rodney Aldborough Agriculture Society to add a permanent sign to the Rodney “signs” located on the main roads leading into town, subject to size and exact location being approved by municipality. Council approves of the severance. NO. 9 Moved by Wiehle Seconded by Balint RESOLVED that the mover be granted leave to introduce a By-Law to provide for maintenance of the Ashton Municipal Drain and this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried SUBJECT: ASHTON DRAIN MAINTENANCE TENDER Council received the following quotes for the Ashton Drain maintenance: Darrell Dick $ 6,149.00 plus taxes Timmermans Drainage $ 5,400.00 plus taxes RES. NO. 10 Moved by Wiehle Seconded by Bodnar RESOLVED that the Council of the Municipality of West Elgin accepts the quote of Timmermans Drainage in the amount of $5,400.00 plus taxes for maintenance on the Ashton Drain. DISPOSITION: Carried SUBJECT: BETHEL PARK - SITE PLAN CONTROL EXEMPTION Bethel Haven has applied for a permit to build a new bunkhouse. The existing cabins on Sites 7 to 11 will be removed and a new bunkhouse built. They have requested exemption from Site Plan Control, which is required under the Official Plan. RES.NO. 11 Moved by Balint Seconded by Bodnar RESOLVED that Bethel Park be exempted from Site Plan Control on Concession 13, Lot 4 – NW 1/4 for construction of a bunkhouse and removal of cabins #7 to 11. DISPOSITION: Carried SUBJECT: EMERGENCY VOLUNTEER TRAINING The Administrator reported that the Red Cross will be conducting training sessions th for volunteers on November 26 and 27 in St. Thomas. The volunteers will help in emergency situations. The cost is $150/person for training plus mileage to be paid. There is also preparation required. Council directed that we advertise for volunteers to take the training. SUBJECT: WINTER CONTROL The Road Superintendent presented a written report to council on winter control and weekend patrols. His report outlined cost savings in having the occasional employee do road patrols. A by-law will have to be prepared. RES.
