June 22, 2006 Public Rezoning Meeting M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN PUBLIC MEETING WEST ELGIN COUNCIL CHAMBERS JUNE 22, 2006 MEMBERS PRESENT: Mayor Graham Warwick, Deputy Mayor Bernie Wiehle Councillors: Trudy Balint, Mary Bodnar, Michael Mooser STAFF PRESENT: Norma Bryant Clerk ALSO IN ATTENDANCE: Ted Halwa Planning Consultant SUBJECT: REZONING – PART LOT 9, CONC VIII – 1079245 Ontario Limited Also in attendance: Harry Ossell The Mayor called the meeting to order at 10:00 a.m. The Clerk informed those present that notice of this meeting had been given under Section 34(12) of the Planning Act by prepaid first class mail to all assessed owners within 150 metres of the subject property as well as provincial agencies and ministries as prescribed by regulation. Correspondence was received from the Lower Thames Valley Conservation Authority advising of no objections. The proposed amendment would change the zoning of lands lying on the south side of Queens Line east of Rodney, being part of Lot 9, Concession VIII, from the Agricultural (A1) Zone to the Rural Residential Three (RR3) Zone and to the ‘site-specific’ Agricultural (A1-#) Zone. The re-zoning is necessary to maintain compliance with the Zoning By-law and to fulfill a condition imposed by the County of Elgin Land Division Committee in granting permission to sever a parcel occupied by an existing single unit dwelling and storage shed out of a larger 16 hectare (39 acre) parcel. The parcel being severed is for the purpose of disposing of a surplus farm dwelling (Application for Consent E110/05). The criteria to create a lot to dispose of a surplus farm dwelling are set out in the Township of Aldborough Official Plan and the Provincial Policy Statement and have been determined to be satisfied. ) The lands proposed to be zoned Rural Residential Three (RR3comprise a rectangularly-shaped parcel having an area of 2,561 square metres (0.6 acres), a depth of 64 metres (210 ft) and a frontage of 40 metres (131 feet). The single unit dwelling on the parcel was erected circa 1946. The permitted uses of the RR3 zone include a single unit dwelling, a home occupation and an accessory use. The lot would satisfy the minimum lot area, maximum lot area and minimum lot frontage requirements (1,850 sq. m., 4,000 sq m. & 30 m respectively) of the RR3 zone. The lands proposed to be zoned ‘site-specific’ Agricultural (A1-#) comprise the remainder of the lands having a frontage of 264 metres (866 feet) on Queens Line and an area of approximately 16 hectares (39 acres). The parcel is occupied by a single unit June 22, 2006 …Pg 2 of 2 dwelling (22759 Queens Line) and two barns. The proposed ‘site-specific’ (A1-#) zoning would permit a further reduction in the size of the parcel below the minimum lot area requirement (i.e.19 ha or 48 ac) of the A1 zone. The subject lands are designated 'Agricultural'in the Township of Aldborough Official Plan. The amendment is considered to be in conformity with the Plan.
