20-16 Repel Pandemic Plan by-law March 24, 2020CORPORATION OF THE COUNTY OF ELGIN By -Law No.: 20-16 Being a By -Law to Repeal and Withdraw the Elgin County Pandemic Plan Dated and Approved November 10, 2009 WHEREAS the Corporation of the County of Elgin, by Resolution of its Council made November 10, 2009, approved a Pandemic Plan ("Elgin County Pandemic Plan") to be implemented in the event of the occurrence of a pandemic, as defined therein, within all or any part of the territorial limits of the County of Elgin; AND WHEREAS, on March 17, 2020, and pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act, the Lieutenant Governor of Ontario, at the recommendation of the Premier, declared that a state of emergency exists throughout the Province of Ontario relating to the COVID-19 pandemic; AND WHEREAS, on March 21, 2020, and pursuant to section 4(1) of the said Emergency Management and Civil Protection Act, the Warden of the Corporation of the County of Elgin declared that a state of emergency exists in the County of Elgin relating to the said COVID-19 pandemic; AND WHEREAS review of the said Elgin County Pandemic Plan as referred to above has revealed potential deficiencies in the format and detail of such Plan which could undermine its effectiveness if and when fully implemented and, furthermore, which otherwise overlap the Emergency Response Plan referenced immediately below; AND WHEREAS, in addition to and independent of the said Elgin County Pandemic Plan, Elgin County has developed and maintained an approved Emergency Response Plan (hereinafter "Elgin County Emergency Response Plan"), last updated and approved by Council pursuant to By -Law 18-37 enacted November 27, 2018, which Plan, by its currency, scope, and detail, will more effectively respond to issues arising in relation to the COVID-19 pandemic; AND WHEREAS the Elgin County Emergency Response Plan has been effectively implemented in response to the Declarations of a state of emergency by both the Province of Ontario and Warden of the County of Elgin as referenced above; AND WHEREAS Council of the Corporation of the County of Elgin, on the advice of its senior administration, have determined it advisable and in the best interests of the health and safety of the residents of the County of Elgin to provide for and maintain implementation of only the Elgin County Emergency Response Plan to respond to a pandemic, including the CORVID-19 pandemic, within the territorial limits of the County of Elgin; NOW THEREFORE the Corporation of the County of Elgin, by its Council, and enact as follows: 1. That the Elgin County Pandemic Plan dated and approved by Council on November 10, 2009, be and said is hereby terminated and repealed.
