"BEING A BY-LAW TO APPROVE AND AUTHORIZE EXECUTION OF A COLLECTIVE
AGREEMENT BETWEEN THE CORPORATION OF THE COUNTY OF ELGIN AND
THE ONTARIO NURSES' ASSOCIATION WITH RESPECT TO ALL NURSES AT
ELGIN MANOR, TERRACE LODGE AND BOBIER VILLA"
WHEREAS, by Sections 11(1) and 11(2)7 of the Municipal Act, 2001, S.O.
2001, Chapter 25, as amended (the "Act"), an upper -tier municipality is granted the power
to pass by-laws relating to any service or thing that the municipality considers necessary or
desirable for the public, which jurisdiction has been interpreted and determined to extend
to and include the power to negotiate and execute collective agreements; and
WHEREAS the Corporation of the County of Elgin is an upper -tier municipality as
provided for in the said Act; and
WHEREAS the Corporation of the County of Elgin owns and operates three (3)
Long Term Care Homes within the territorial limits of Elgin County, namely, Elgin Manor,
Terrace Lodge, and Bobier Villa; and
WHEREAS the Ontario Nurses' Association, by certificate dated December 9th,
1988, is the certified bargaining agent for all Nurses at Elgin Manor; save and except the
Director of Nursing and persons above the rank of Director of Nursing; and
WHEREAS the Ontario Nurses' Association, by certificate dated January 12th,
1989, is the certified bargaining agent for all Nurses at Terrace Lodge, save and except
the Director of Nursing and persons above the rank of Director of Nursing; and
WHEREAS the Ontario Nurses' Association, by certificate dated June 1st, 1981, is
the certified bargaining agent for all Nurses at Bobier Villa, save and except the Director of
Nursing and persons above the rank of Director of Nursing; and
WHEREAS negotiations have taken place over a period of time, between the County
and the Union towards amending the collective bargaining relations and providing an orderly
procedure for the disposition of grievances and defining working conditions and terms of
employment for all employees who are represented by the Union, in the form of a Collective
Agreement; and
WHEREAS agreement has now been reached by both parties on the said procedures,
conditions and terms of employment to be included in an agreement to cover the period
commencing April 1, 2020, and ending March 31, 2023.
NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin
enacts as follows:
1. THAT Elgin County Council approve the Collective Agreement between the County of
Elgin and the Ontario Nurses' Association, for the period commencing April 1, 2020
and ending March 31, 2023, setting forth collective bargaining relations, disposition of
grievances and to define working conditions and terms of employment for all nurses at
Elgin Manor, Terrace Lodge and Bobier Villa; and,
2. THAT the Warden and the Chief Administrative Officer be and are hereby authorized
to sign the Collective Agreement between the County of Elgin and the Ontario Nurses'
Association, for the period commencing April 1, 2020, and ending March 31, 2023.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 25TH DAY OF
